Bain to appeal sentence for election-night shooting

The lawyer who represented Richard Henry Bain during his murder trial intends to file an appeal of the sentence he received last month. 

Alan Guttman told the Montreal Gazette on Thursday that the appeal will be filed some time soon. The normal time limit to file an appeal is 30 days. The sentence was set on Nov. 18. 

Bain was convicted of second-degree murder in the death of Denis Blanchette, a stagehand who was shot ‎around midnight on Sept. 4, 2012, outside the Metropolis nightclub. Premier-elect Pauline Marois was inside the club at the time delivering a speech to the Parti Québécois following their victory in that day’s election.

He automatically received a life sentence after being convicted of murder. And last month Quebec Superior Court Justice Guy Cournoyer set Bain’s parole eligibility at 20 years after Guttman had requested it be set at 10.

Cournoyer called Bain’s crimes (he was also convicted of attempted murder) “an attack on democracy” because of his intention to kill as many members of the PQ party as possible that night.
